When you are about to retire or already retired, you want to ensure that your income from your retirement savings would be there on a regular basis while you are still alive.
You may not want to take bigger risk that you would lose a sizeable chunk of your savings and income from big fluctuations in the stock market. The fiduciary requirement by the Department of Labor has the effect of limitng the number of agents who could still serve the mass consumers, because only agents who charge a fee and limit their markets to the upper income group, can feasibly function. Regulations by the federal government on top of the effective state regulatory requirements would be a duplication and overwhelm the ordinary agents who serve the mass consumers without charging an hourly or minimum lump sum fee, especially if many mass consumers only have less than $50,000 in retirement funds.
